Please read the following important terms and conditions before you apply to join Spike Island as a Patron and check that they contain everything which you want and nothing that you are not willing to agree to.
This contract sets out both your and our legal rights and responsibilities, as well as certain key information required by law.

The details of this contract will not be filed with any relevant authority by us.

Spike Island Patron Scheme provides an opportunity for Spike Island supporters to become patrons and thereby help us in our mission to support emerging and underrepresented artists to thrive.

2.2 Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities if you have a query or complaint about the use of your personal information.
3.1 Below, we set out how a legally binding contract between you and us is made.
3.2 You select a Patron type on the website and proceed to the payment stage. Please read and check your order carefully before submitting it.
3.2.1 When you complete your order at the end of the online checkout process we will acknowledge it by email. This acknowledgement does not, however, mean that your order has been accepted. We will only accept your order when we email you a ‘Welcome and Thank you Email’ which will normally be within the next 10 working days. If you have not received a ‘Welcome and Thank you Email’ within 10 days of your order, please contact us by email at lucy.macdonald@spikeisland.org.uk or call us on 0117 929 2266. We will respond to you as soon as possible within normal working hours.
3.2.3 We will only accept your order when we email you to confirm this (Welcome and Thank you Email).
At this point:
a) this binding contract will be in place between you and us; and
b) you will be eligible to receive your patron level benefits
3.3 Your patronage is annual and your payment covers a period of one year from receiving your ‘Welcome and Thank you Email ’. If for any reason your payment cannot be processed, we will contact you within 5 working days to explain the nature of the issue.
3.3.1 Unless you and we agree otherwise, if we cannot complete your Patron sign up process within 30 days, we will:
3.3.2 let you know; and
3.3.3 cancel your order; and
3.3.4 give you a refund. Please note refunds are only given in specific circumstances. Refunds are not possible for Patrons other than if we cannot complete your patron sign up process within 30 days or you cancel your patronage within the 14 day cooling off period.
3.4 Spike Island will not recognise your patronage publicly without your permission and you can revoke permission at any time, within a reasonable time period. If you revoke your permission, Spike Island will remove any public recognition as soon as is reasonable possible (taking into consideration time, staffing and costs) and only so far as is reasonably possible and practicable.
3.5 If you are under the age of 18 you may not join us as a Spike Island Patron
4.1 As a Patron you are entitled to the list of benefits as listed on the relevant Artist Champion, Artist Patron and Director’s Circle pages on the website.
4.1.1 Artist Patron annual benefits include:
a) An invitation to x 1 Exhibition Preview Dinner per annum
b) x 1 Curator-led tour for each new exhibition season (for a max. of x 10 people per tour) per annum
4.1.2 Director’s Circle annual benefits include:
a) An invitation to x 2 Exhibition Preview Dinners per annum
b) x 2 Curator-led tours for each new exhibition season (for a max. of x 10 people per tour) per annum
c) An invitation to x 1 behind the scene lunches/breakfasts for each new exhibition season per annum
d) x 1 VIP ticket to Frieze Art Fair per annum
4.2 A discount on limited edition prints will be granted on proof of patronage. Please contact us on the details above to request a discount code. We reserve the right to exclude certain limited edition prints on rare occasions.
4.3 Complimentary copies of new Spike Island publications will be sent periodically, as these are produced for specific projects.
4.4 By becoming a Spike Island Patron, you will receive certain benefits to the value of the cost of the Spike Island Patrons level you choose. You are encouraged, but not obliged, to give a further contribution that is not linked to the benefits you receive. The contribution will be eligible for gift aid and will help support our charitable objectives.
For Gift Aid and VAT purposes, your contribution is split for Director’s Circle is as follows:
Directors’ Circle: £2,000 – benefit value: £121, donation £1,879
4.5 We reserve the right to cancel or change patron benefits during a Patron’s year of membership. All efforts will be made to notify members of changes ahead of renewals. If you change your mind about your patronage after we have changed any Patron benefits, you will be able to cancel your patron membership immediately, but no refunds will be given for any historic payments.
5.1 To exercise this right to cancel, you must inform us of your decision to cancel this contract by a clear statement (such as a letter sent by post, fax or email) at lucy.macdonald@spikeisland.org.uk or Spike Island, 133 Cumberland Road, Bristol BS1 6UX, UK. You can use the model cancellation form set out in the box below, but it is not obligatory.
5.2 To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

6.1 If you cancel this contract within the 14 days cooling off period, we will reimburse all payments received from you, provided you have not used any of the Patron benefits e.g. attended an event.
6.2 We will make the reimbursement without undue delay, and not later than 14 days after the day on which we are informed about your decision to cancel this contract.
6.3 We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
7.1 Outside of the 14 days cooling off period, you can cancel your Patronage at any time using the same cancellation form above. Spike Island Patron Scheme is an annual programme with the option to pay annually or monthly to spread the cost over a year period. If you sign up to pay monthly and wish to cancel your patronage part-way through the year, you will continue to pay the remaining balance owed for the rest of the year until your patronage ends.
8.1 Spike Island uses www.gocardless.com to process Patron membership payments by Direct Debit. This secure merchant is independent and will never disclose your full payment details to us. 8.2 We will do all that we reasonably can to ensure that all of the information you give us when paying for your Patron level is secure by using an encrypted secure payment mechanism. However, in the absence of negligence on our part, any failure by us to comply with this contract or our Privacy Policy (see clause 2) or breach by us of our duties under applicable laws we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you give us.
8.3 Nothing in this clause affects your legal rights to cancel the contract during the ‘cooling off’ period under clauses 5.
8.4 The price of patron levels:
8.4.1 is in pounds sterling (£)(GBP);
8.4.2 includes VAT at the applicable rate
8.5 Please note you are responsible for complying with local tax laws.
If this contract is ended it will not affect our right to receive any money which you owe to us under this contract.
Patronage does not automatically end after a term of one year. It is your responsibility to end the contract when you want the contract to end, according to our cancellation terms.
10.1 Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, we are not legally responsible for:
10.1.1 losses that:
a) were not foreseeable to you and us when the contract was formed; or
b) that were not caused by any breach on our part;
10.1.2 business losses; and
10.1.3 losses to non-consumers.
11.1 We will try to resolve any disputes with you quickly and efficiently.
11.2 If you are unhappy with:
11.2.1 the goods/services;
11.2.2 our service to you; or
11.2.3 any other matter,
please contact us as soon as possible using the details in the ‘Who we are’ section above.
We adhere to fundraising regulation and best practice, including the Fundraising Regulator’s Code of Fundraising Practice.
11.3 If you and we cannot resolve a dispute using our internal complaint handling procedure, we will:
11.3.1 let you know that we cannot settle the dispute with you.
12.1 No one other than a party to this contract has any right to enforce any term of this contract.
